Terms & Conditions for the use of Click & Collect

1. General Provisions

1.1. Click & Collect is hosted by:

1118 CP Schiphol, the Netherlands

(hereinafter referred to as “SNBV”).

1.2. These terms & conditions of use (hereinafter referred to as “the Terms”) apply to all interactions between SNBV and users of Click & Collect (hereinafter referred to as "User").

1.3. The relevant statutory requirements shall apply unless they are directly changed or explicitly excluded by the Terms insofar as permitted by law.

1.4. SNBV reserves the right to adjust the Terms to account for any future business, legal, or technical developments. The currently valid Terms that can be viewed on the Click & Collect website shall apply.


2. Subject and scope of the Click & Collect services

2.1. SNBV provides an online retail platform (hereinafter referred to as “the Platform”) for commerce between sellers of products (hereinafter referred to as “Seller”) and Users. Sellers also operate a physical shop at Amsterdam Airport Schiphol. On behalf of these Sellers, SNBV organizes an online reservation process. Users can use Click & Collect to reserve products offered by a Seller. SNBV handles the reservation processes through the online Click & Collect environment.

2.2. The User’s contractual partner for a potential purchase agreement is the Seller, and in no way can or will SNBV be regarded as such. SNBV is not liable for either the User’s or the Seller’s contractual performance in any way. In case there are complaints about the Seller’s performance, the User may only address these to the Seller.

2.3. Use of Click & Collect is free of charge for Users. Only natural persons with unlimited legal capacity may reserve products. Users may reserve the offered products as guests (therefore not as registered customers), by submitting their name, email address, mobile telephone number and flight information.

2.4. SNBV plans to operate Click & Collect on a long-term basis. However, the User has no legal claim to future use of it. SNBV may at any time, without further notice being required, decide to cease operating Click & Collect, such to its sole discretion.

2.5. SNBV reserves the right to change, extend, or reduce the content, structure, and design of Click & Collect to its sole discretion.

2.6. SNBV is entitled to temporarily limit the usability of Click & Collect, individual functions thereof, or access to it if there are legal or technical reasons for doing so. In particular, these technical reasons can be, but are not limited to, maintenance work, updating of underlying software, or measures to ensure the security or integrity of Click & Collect.


3. Ordering of products

3.1. The Sellers’ offers constitute appeals to Users to reserve products without any obligation for them to actually purchase these products.

3.2. To reserve, the User selects products on Click & Collect by clicking the “Add to cart” button to place them in the shopping cart, then going to the shopping cart and clicking the “Proceed to checkout” button.

3.3. Then the User must submit his/her name, email address, mobile telephone number and flight number..

3.4. Before submitting this offer, the User can check and change the entered data and the selected products or abort the reservation. The User is also asked to carefully double check his/her entries before submitting the reservation.

3.5. After the reservation is submitted, the User receives an email confirmation from SNBV. This is only to inform the User and does not signify acceptance of his/her offer.

3.6. In connection with the reservation, reserved products are made available for purchase in the shop at the airport free of charge without any obligation on the part of the User to actually do so. A purchase agreement between the User and Seller only arises in the shop.

3.7. In the event that one day after the User’s flight has lapsed, the User has not yet collected a reserved product, the relevant reservation will be cancelled automatically.

3.8. The product illustrations are only approximations and may exhibit colors etc. that deviate from the actual products.

4. Prices and Payment

4.1. All indicated prices include the statutory value-added tax. They are given in euros (€).

4.2. In connection with the reservation, the User must pay for reserved products when picking them up from the Seller’s shop at the airport using one or more of the modes of payment offered by the Seller. The User will receive his/her invoice(s) when picking up his reservation(s) at the shop(s).

4.3. Any pricing information on the Platform can contain errors. SNBV is not responsible for any deviations and the User cannot derive any rights from the prices indicated on the Platform. In the event of any deviations from the actual prices as they appear in the shop, the User is free to elect not to purchase the reserved products against no charge.

4.4. In the event of a promotion that applies on a product reserved by a User, the following applies:

a. in the event the User makes a reservation for a product against the regular price, but at the actual moment of pickup in the shop a promotion price on the product applies, the User will pay the lower (promotion) price; and

b. in the event the User makes a reservation for a product against a promotion price, but at the actual moment of pickup in the shop the regular price on the product applies again, the User will pay the lower (promotion) price.

4.5. In the event of a reservation of a product which is sold by multiple Sellers, the User cannot derive any rights against any of the Sellers from this difference in pricing. Sellers cannot be held to offer products against lower prices based on the fact that other Sellers are selling the same product for lower prices.

5. Conduct on the Platform

5.1. Click & Collect and the underlying database may only be used as intended by SNBV.

5.2. It is prohibited:

a. to evade or disable functions (e.g. search windows) of the website or to otherwise interfere with SNBV’s website and in particular to take any action that could overload the infrastructure of SNBV’s website,

b. to block, overwrite, or modify content generated by SNBV, or

c. to use automated functions (e.g. algorithms or machines) to reserve products.

5.3. It is also prohibited:

a. to act fraudulently or deceitfully,

b. to distribute, initiate, or advertise spam, chain letters, or pyramid systems,

c. to collect or in any way obtain and store information of or about other Users, and in particular e-mail addresses and telephone numbers, without their permission, or

d. to send or make accessible viruses or other harmful software that could impair or damage SNBV’s websites or the computer systems of other users.

6. Consequences of violations

If there is concrete evidence of violations of these Terms, laws or other legal provisions, or the rights of third parties, SNBV reserves the right to:

a. warn the User,
b. temporarily limit or block the User’s access to Click & Collect, and/or
c. to definitively block the User’s access if there are important grounds to do so.

7. Intellectual Property

The content (texts, images, graphics, etc.) and information on Click & Collect are the intellectual property of SNBV or the respective Seller(s). The trademarks and the pack shots remain the intellectual property of the respective brand(s). It is prohibited to reproduce, disseminate, otherwise publicize, or process them without the consent of the party that owns the rights. It is only permissible to use this content after obtaining the written consent of SNBV, the Seller(s) or the brand(s) concerned.

8. Limitation of Liability and return policy

8.1. SNBV accepts no liability for the products advertised by the Sellers or for any purchase agreement between Users and Sellers, such in the broadest sense as permitted by law.

8.2. To the extent that SNBV’s liability is excluded or limited, this also applies to the personal liability of its employees, representatives, and agents.

8.3. SNBV is in no way involved in or responsible and/or liable for any return policies of products. The User is responsible for checking and verifying any applicable product return policies with the relevant Seller.

9. Contractual Language and Applicable Law

9.1. The Dutch language version of these Terms is legally binding.

9.2. These Terms are exclusively subject to the laws of the Netherlands. Any disputes arising from or in connection with these Terms and/or (the use of) Click & Collect, will exclusively be brought before the competent court in Amsterdam.
